Information Text on the Processing of Personal Data

Within the scope of the Personal Data Protection Law No. 6698 ("Law"), your personal data will be processed by FAZ Oto Kiralama A.Ş. ("Europcar Turkey") as the Data Controller within the scope of car rental offers and contracts, in accordance with the law and the rules of integrity, within the framework explained below. 

1. Purpose and Legal Reason for Processing Personal Data: 

Your personal data may be processed in accordance with the basic principles and data processing conditions set out in the Law, by taking all kinds of data security measures and in line with the personal data processing purposes and legal reasons detailed below. 

Personal data processed for the purposes of performing vehicle rental, order and reservation transactions, processing cancellation requests, performing risk assessment, determining rental conditions and fees, performing invoicing activities, creating appointments, making offers, performing vehicle maintenance services, providing HGS, providing vehicle rental insurance, accident and damage management and additional services upon your request, providing towing and roadside assistance in case of breakdown and accident, and performing after-sales support services; Based on the condition that the processing of personal data belonging to the parties to the contract is necessary, provided that it is directly related to the establishment and performance of the contract in accordance with subparagraph (c) of paragraph 2 of Article 5 of the Law; 

Personal data processed for the purpose of reporting to authorized institutions, fulfilling information and document provision obligations, verifying identity, and recording communication in order to fulfill obligations arising from laws and relevant legislation; based on the condition that data processing is mandatory for the data controller to fulfill its legal obligation in accordance with subparagraph (ç) of paragraph 2 of Article 5 of the Law;

Personal data processed for the purposes of exercising recourse rights, collecting fees for services provided, making refunds, assessing compensation, receiving requests and complaints, and keeping records that may constitute evidence in disputes for the periods specified in the legislation; in accordance with subparagraph (e) of paragraph 2 of Article 5 of the Law; based on the condition that data processing is mandatory for the establishment, exercise or protection of a right;

Personal data processed for the purposes of ensuring the security of company operations and vehicles, reporting vehicle malfunctions, recording vehicle deliveries and returns, assessing the customer's financial risk, planning and executing customer relations management processes, following up and executing legal affairs, conducting information security and audit processes, planning and executing customer satisfaction activities; in accordance with subparagraph (f) of paragraph 2 of Article 5 of the Law; based on the condition that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person;

Your personal data processed by our company and authorized dealers  for the purpose of presenting our company's products and services and sending promotional and marketing commercial electronic messages through SMS, telephone, automatic calling machines, e-mail and similar communication channels; based on the condition of "explicit consent" within the scope of the first paragraph of Article 5 of the Law;

In the event that you are involved in an accident resulting in bodily harm, your health data (special personal data) processed for the purpose of providing after-sales support services; based on the condition of “explicit consent” within the scope of the second paragraph of Article 6 of the Law;

can be processed. 

2. Method of Collection of Personal Data:

In line with the above-mentioned, your personal data may be obtained, processed and updated through Europcar Turkey headquarters and regional directorates, branches, rental offices, call center, website, web branch, digital channels, social media accounts, e-mail, call center, dealers, affiliates, official institutions, banks and service channels; verbally, in writing or electronically; by fully or partially automatic means or non-automatic means as part of any data recording system.

3. Transfer of Personal Data:

For the purposes specified above, your personal data may be transferred to supervisory and regulatory authorities and relevant public institutions, professional organizations and similar organizations, and persons or organizations permitted by the provisions of the legislation, shareholders, community companies and affiliates, rental offices, damage repair centers, insurance companies, persons and organizations from which services are received and cooperated to carry out their activities subject to the purposes specified in the legislation, and support service providers to the extent permitted by the legislation.

You can send your requests within the scope of Article 11 of the Law, which “regulates the rights of the relevant person”, to our company in writing, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller,  at fazotokiralama@hs03.kep.tr or FDN Plaza Soğanlık Yeni Mah.
